General terms of sales

General conditions of sale.
These conditions and terms are a contract between Rakatanga Tour Europe SL. CIF: B-37569829, with identification of Travel Agency number CICL.37-116 and with registered office at Calle Sánchez Llevot 1. 37005 Salamanca, Spain. and the person, or participant, who book a trip (the client) offered on our website www.rakatanga-tour.com or directly to the client in the case of a private or a la carte trip.
Booking one of our trips implies full acceptance of all the terms and conditions of this contract.

Registration and reservation
Your registration will be considered effective upon receipt of the registration form and your reservation. This reservation must be accompanied by a signal of € 500 per person and trip, (€ 750 for the tours of Bhutan and Tibet) if the reservation is made 30 days before the start of the trip. In the case of trips to Bhutan and Tibet, the total payment must be paid 45 days before the trip in order to obtain the visa and confirmation of hotels according to the official rules of the government of Bhutan and the procedure in Tibet.
If the reservation is made less than 30 days (45 days in Bhutan and Tibet) of the date of commencement of the trip, 100% of the price of the trip must be paid. Your reservation will be confirmed by email or in writing. All trips must be paid in full 30 days before their start, 45 days for trips in Bhutan and Tibet. Otherwise Rakatanga Tour reserves the right to cancel the reservation and keep the entire payment as compensation.
In the case of private tours or the letter, payments will have to be made 60 days before the start of the tour.

Cancellation
Cancellation by the client.
The management, cancellation and penalty fees must be paid based on the time remaining for departure, which will be:
- More than 40 days before the start date of the trip and up to 60 days in the case of trips to Bhutan and Tibet: 100% refund of the payment after € 70 deducted per person from bank and management expenses.
- Between 30 and 40 days before the start date of the trip (between 45 and 60 days Bhutan and Tibet). Reimbursement of 50% of the trip once deducted € 70 per person for bank and management expenses.
- Less than 30 days (less than 45 days for tours in Bhutan and Tibet) before the start date of the trip. No returns will be made.
- Non-presentation: In cases of non-presentation, delay, arrival after the start of the trip, inability to provide documents or comply with the necessary procedures to enter and travel to the country (passport, visa, driving license, etc.). No returns will be made.
The date of the day on which the bank transfer is made will be taken as the payment date, only the bank receipt is accepted as proof.

Cancellation by the client in the case of a private or à la carte tour
The management, cancellation and penalty fees must be paid based on the time remaining for departure, which will be:
More than 60 days before the start date of the trip: 100% reimbursement of the payment after deducting € 70 per person from bank and management expenses.
Between 45 and 30 days before the start date of the trip. Reimbursement of 50% of the trip once deducted € 70 per person for bank and management expenses.
Less than 30 days before the start date of the trip. No returns will be made.

In case of cancellation by the organization:
In the unlikely event that Rakatanga Tour cancels its trip, the organization undertakes to return 100% of the payment made without any management fees.

In case of cancellation due to external circumstances and outside our organization:
Some unforeseen events may force Rakatanga Tour to change/modify and/or cancel some benefits or the entire trip: force majeure, natural disasters, acts of war, risk conditions for driving, strikes, closures, bad road conditions etc. In these circumstances Rakatanga Tour assumes no responsibility and no refund or refund will be made. In these cases of extraordinary situations and in which the organization must provide extra nights in hotels, or extra services not provided for in the initial trip, the client must cover these costs. When any provision or service included in the program cannot be provided, Rakatanga Tour will make every effort to propose similar services to the client or will proceed to its reimbursement. However, the customer must pay the difference if there is any price increas
 
Interruption and late arrival after the starting day of the trip.
The interruption of the trip by a participant, for whatever reason, will not result in any refumd. All possible expenses generated in the case of arriving later than the start of the trip or due to the interruption of the trip (motorcycle transport, extra rooms, plane ticket, extra transfers or any other service not contemplated in the initial trip) must Be paid by the customer.
 
Modification of the trip
You can modify and change your trip or its dates, more than 30 days after its start. Bank and management fees of € 70 per person will apply. Any modification within 30 days of departure will be considered as an annulment and the penalties mentioned above will apply. Any modification that involves providers of services outside Rakatanga Tour (carriers, guides, airlines, hotels, etc.) may have, in addition to the Rakatanga Tour penalties and described above, the penalties that each provider applies.
 
Modification and change of Itinerary by the organization
The organization reserves the right to modify, alter or cancel any part of the itinerary of scheduled motorcycle tours in Asia, at any time and without prior notice. Motorcycle trips in the destinations we offer are particularly complex due to unpredictable weather situations and variable road conditions. These factors may require last minute changes to the itinerary to ensure the safety of participants and the viability of the tour.
Likewise, the description of the day-by-day trip published on our website is only indicative and should not be taken as something rigid or something that will be followed to the letter. Travel circumstances may vary, and flexibility is essential for these types of adventures.
These possible modifications may occur before the start of the trip or once it has begun. In the latter case, our guides will decide them directly for logistical convenience or for the comfort of the participants, without these being the reason for future claims.
In the event of modifications, the agency will make the necessary decisions based on the best interest of the travelers and cannot in any case be held responsible for any losses or inconveniences that such modifications may cause to the participants.
Travelers are advised to be prepared for possible changes and adapt to travel circumstances.
 
Prices
The price of each trip is the one that appears on the website www.rakatanga-tour.com or those provided directly to the client in cases of trips on demand. The services included and not included in the trip are specified in the description and detail of each one.
 
Litigation
Rakatanga Tour and the participant agree to submit to the exclusive jurisdiction of the courts of Salamanca, Spain, if any dispute or disagreement could not be resolved by mutual agreement. Any payment due after 6 months from the date of receiving our invoice, will have an extra haddling fee of 190€.
 
Responsibility
Rakatanga Tour cannot replace the individual responsibility of each participant. Each participant must be in charge of obtaining all the documents (identity documents, visas, International Driving Permit etc.) necessary for the correct execution of their stay in the country of destination. As a travel organizer, Rakatanga Tour works with the different suppliers (receptors, hotels, carriers and suppliers of various services). At no time should you be confused with the latter who retain their own responsibility.
 
Risks
Our trips include outdoor and motorcycle activities, which entails certain risks inherent in the trips we propose. Each participant consciously assumes these risks and agrees not to take responsibility for accidents or incidents that may occur in the course of the trip to Rakatanga Tour, its directors, its guide or its different suppliers. This clause also applies to members of the participant's family. Each participant must comply with the precautionary rules and follow the advice given by the group guide, who cannot be held responsible for accidents resulting from the performance of a participant. Rakatanga Tour reserves the right, if necessary, to modify the itinerary or some parts of the program, as a result of special or exceptional circumstances in which the security of the group is at stake. This will be done directly or through the group guide.
The client acknowledges and certifies, in the case of a motorcycle trip, that he is in possession of a national motorcycle driving license and an International Motorcycle Driving License valid in the country where the trip is organized. Likewise, the client certifies their authenticity.
 
Deposit for motorcycle use
The deposit for the use of the motorcycle is intended to cover possible small damages caused to the vehicle. In no way can it be understood as an amount that covers all damages or repairs of great value.
Your maximum responsibility in case of total destruction of the motorcycle due to an accident is limited to:
• Model Royal Enfield tours in Nepal, India, Bhutan, Tibet: € 1700
• Motorbikes on any of our tours in Thailand, Argentina and Mongolia: € 7,000
In the case of an accident, the customer assumes and accepts the advance payment for the repair of the motorcycle
(with the maximum liability limits indicated above in case of total motorcycle accident) pending the future refund of the compensation of the motorcycle insurance. Once this compensation has been obtained, if any, Rakatanga Tour will deliver it to the client.
To leave the deposit we use a new system in line with the French company Swikly without having to pay it in advance. The amount will not be charged to your card, it is simply a pre-agreement that will be automatically canceled 20 days after the end of the trip if the motorcycle has not suffered any damage.
It also serves for possible extra requests during the trip (extra hotel nights, flights, transfer etc)
Note: Our motorcycles in Asia have third party insurance that does not cover the material damage of your own motorcycle.
Participants who have subscribed the Moto Plus Coverage option will have a coverage of up to € 1100 for possible damage to their motorcycle, which will be directly taken care of by Rakatanga Tour.

Conditions of application of the Moto Plus Coverage option.

All motorcycles in our fleet in India have third party insurance that covers material and personal damages to third parties in the event of an accident. Insurance companies in Asia do not insure motorcycles for commercial use at full risk.
That is why we offer the possibility of opting for Moto Plus Coverage for the following destinations:

             - India, Nepal, Tibet, Bhutan, Sri Lanka and Thailand.
This option allows you to have extra coverage (which does not have mandatory third party insurance) in case of material damage to your own motorcycle. The extra coverage only and only applies to the material damages of the participant's motorcycle.
The participant who subscribes to this option will have the inclusions indicated below, and the organization will be responsible for all expenses incurred with a total accumulated maximum of € 1100.

Example: In the case of a repair for a total cost of € 1200. The organization will pay the first € 1100 and the participant must only pay the difference, ie € 100.
Note: Subscription to this option does not exempt the obligation of the deposit of the deposit.

The Moto Plus Coverage option has a limit of € 1100 and the maximum responsibility in case of total motorcycle accident is, as stipulated in our general conditions of sale, are the following according to the motorcycle and the chosen tour:

    Model Royal Enfield tours in Nepal, India, Bhutan, Tibet: € 1700
    Motorcycles Thailand CB500X : € 5,000
    Motorbikes on any of other tours: € 7,000
   
The amount of the deposit will not be charged to your card, it is simply a pre-agreement that will be automatically canceled 20 days after the end of the trip if the motorcycle has not suffered any damage or if the participant has not asked the organization for possible extra demands during the trip (extra hotel nights, flights, transfer, motorcycle transportation by default during the tour etc)

Moto Plus Coverage Inclusions
All material damage caused in the event of an accident. This section covers all material damage caused to the motorcycle itself by an accident (including chassis, engine and motorcycle accessories).
Any damage or theft of accessories mounted on our motorcycles. (protection bar, mirrors, luggage carrier, etc.). It does not include the personal accessories that the participant can mount.
Loss or deterioration of parts or elements of the motorcycle during the trip without the need for a material accident. Loss of covers, mirrors, horns, intermittent or any other component of the motorcycle in the normal course of the trip.
Covers, tires and cameras. All punctures or broken tires or tires. The organization will take care of all the cameras in case of punctures of the covers or blowouts and of the tires in case of breakage or deformation.

Not include
The possible accessories that the client can mount on the motorcycle for the use of personal accessories during the trip (camera mounts, magnetic storage bags etc.)
Theft or loss of the participant's personal motorcycle equipment or equipment (helmet, jacket, gloves, cameras, etc.).
In no case does this option cover damages to third parties. Be it material damage to a vehicle or personal damage to third parties. (Our bikes have mandatory third party insurance in those cases).
Personal or physical damage of the driver or passenger. This option does not cover any damage that is not exclusively material on the participant's motorcycle.
The theft of the motorcycle.
